DMCA / Copyright Policy

Cars4k respects the intellectual property rights of others and expects contributors and users to do the same. This page explains how to report content you believe infringes your copyright, and how to respond if your own content was removed in error.

1. Filing a Copyright Infringement Notice

If you believe content hosted on Cars4k infringes your copyright, send a written notice to our Designated Agent (Section 5) that includes all of the following, as required under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing, with enough detail for us to locate it (e.g. the Cars4k page URL).
  • Your contact information: name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

A notice missing any of these elements may not be actionable under the DMCA. We do not act on anonymous reports or reports that do not identify specific content.

2. Our Response

On receiving a valid notice, we will remove or disable access to the identified content, notify the contributor who submitted it, and record the action. Repeated or clearly invalid notices may be disregarded.

3. Counter-Notification

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to our Designated Agent that includes:

  • Your physical or electronic signature.
  • Identification of the removed material and where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, if outside the US, any judicial district in which Cars4k may be found), and that you will accept service of process from the person who filed the original notice.

Unless the original complainant files a court action seeking to restrain the contributor from the infringing activity, we may restore the removed content within 10–14 business days of receiving a valid counter-notice, as required by law.

4. Repeat Infringer Policy

A contributor account that is the subject of repeated, valid infringement notices will be suspended from submitting further content, consistent with our Contributor Agreement, which requires every contributor to represent that they hold the rights to what they submit.

5. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that content is infringing, or that it was removed by mistake, may be liable for damages. Please only file a notice or counter-notice if you believe, in good faith, that it is accurate.
