Terms of Service

1. Acceptance of These Terms

Cars4k ("Cars4k", "we", "us") is a streaming and licensing platform for automotive video and audio content. By registering for, accessing, or using Cars4k, you agree to be bound by these Terms. If you are using Cars4k on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.

2. Eligibility and Accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use Cars4k.
• You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
• You must notify us promptly of any unauthorized use of your account. We are not liable for losses caused by unauthorized use you could have prevented.
• Accounts are personal to you or your organization and may not be shared except through team seats where offered.

3. Content and License

Cars4k provides access to browse and preview Content, and — depending on your plan — to download and license it. Your rights to downloaded Content are governed by the License Agreement, which forms part of these Terms. Without an active plan, access is limited to browsing and previews; full playback and downloads require an appropriate plan or single-clip purchase.

4. Subscriptions, Billing, and Renewals

• Plans and pricing. Available plans, license scope, download allowances, and prices are shown on our Pricing page. Prices may be billed annually (default) or monthly, as selected at checkout.
• Payment. Payments are processed by our payment provider, Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method for the plan and billing period you select, including applicable taxes.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date.
• Cancellation. You may cancel at any time from your account. Cancellation stops future renewals; your plan remains active until the end of the current paid period.
• Taxes. Prices may exclude taxes. You are responsible for any VAT, sales, or similar taxes, which may be added at checkout.
• Refunds. Except where required by law, payments are non-refundable, including for partially used periods and for single-clip purchases once the clip has been downloaded.
• Founding Garage Pass. Any lifetime or founding offer is subject to its own stated terms and available quantity; "lifetime" means the lifetime of the Cars4k service.
• Changes to pricing. We may change prices for future billing periods; the new price applies at your next renewal after reasonable notice.

5. Acceptable Use

You agree not to:

• Circumvent or attempt to circumvent access controls, download limits, watermarks, or signed-URL protections.
• Scrape, harvest, or bulk-download Content by automated means, or use Cars4k in a way that imposes an unreasonable load on our infrastructure.
• Reverse engineer, copy, or resell the platform, or access it other than through the interfaces we provide.
• Upload malicious code, attempt to gain unauthorized access to systems or other users' accounts, or interfere with the security or operation of Cars4k.
• Use the Content other than as permitted by the License Agreement.
• Misrepresent your identity or use Cars4k for any unlawful purpose.

6. Intellectual Property

Cars4k, including its Content, software, design, trademarks, and branding, is owned by Cars4k or its licensors and is protected by intellectual-property laws. These Terms grant you no rights in the Cars4k brand. The name "Cars4k" is a working name and may change before or after launch.

7. Third-Party Services

Cars4k relies on third-party providers for payments, hosting, storage, streaming, email, and analytics (see our Privacy Policy for the list). Your use of Cars4k may be subject to those providers' terms where applicable. We are not responsible for third-party services outside our control.

8. Availability and Changes to the Service

We work to keep Cars4k available but do not guarantee uninterrupted or error-free service. We may add, change, suspend, or remove features or Content at any time. We may remove Content from the library; this does not revoke a license you already hold in Content you lawfully downloaded.

9. Disclaimers

Except for the express warranty in the License Agreement, Cars4k and the Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Cars4k and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of Cars4k. Our total liability for any claim arising out of or relating to Cars4k or the Content will not exceed the amounts you paid to us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Your Indemnity

You agree to indemnify and hold Cars4k harmless from claims, damages, and expenses arising from your use of the Content outside the License Agreement, your breach of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using Cars4k and close your account at any time. We may suspend or terminate your account if you materially breach these Terms or the License Agreement, if required by law, or to protect Cars4k or its users. On termination, your right to access the platform ends; surviving license rights are governed by the License Agreement, and provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnity) continue to apply.

13. Governing Law and Disputes

These Terms are governed by the laws of [TBD: governing-law jurisdiction], without regard to conflict-of-laws rules. The courts of [TBD: venue] will have jurisdiction over disputes, except where mandatory consumer-protection law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-app notice). Your continued use of Cars4k after changes take effect constitutes acceptance of the updated Terms.
