License Agreement

1. Definitions

• "Cars4k", "we", "us" — the operator of the Cars4k platform.
• "Content" — any video clip, vertical clip, or exhaust-audio file made available for download on Cars4k, including its embedded metadata.
• "Master" — the downloadable, high-resolution source file of a piece of Content.
• "License" — the rights granted to you under this Agreement for a specific piece of Content, determined by your active plan (or single-clip purchase) at the time of download.
• "End Product" — a creative work you make that incorporates the Content together with other material (e.g. a video, film, advertisement, social post, or app), such that the Content is not the primary value of that work.
• "Plan" — the subscription tier (Shorts, Creator, Pro, Studio, or Enterprise) or single-clip purchase under which you access Content, as described on our Pricing page.

2. Grant of License

Subject to your compliance with this Agreement and the Terms of Service, and to your account being in good standing, Cars4k grants you a worldwide, non-exclusive, non-transferable, perpetual license to use each Master you lawfully download while your Plan is active, within the scope of that Plan and subject to the restrictions in Section 5. "Perpetual" means that Content downloaded during an active Plan may continue to be used in your End Products even after your subscription ends, provided you obtained it in compliance with this Agreement.

Cars4k retains all ownership of the Content. You are licensed to use it — you do not buy or own the Content itself.

3. License Scope by Plan

Every plan delivers the same Content at its original resolution; plans differ by license scope and monthly download volume, not quality. The scope that applies to a given Master is the scope of the Plan active when you downloaded it.

• Shorts — personal and monetized social use of vertical clips and exhaust audio (e.g. TikTok, Reels, YouTube Shorts). No horizontal video, no client work.
• Creator — personal and monetized creator use of the full library (horizontal video, vertical, and audio) on your own channels and social platforms.
• Pro — full commercial use, including client and commissioned work, across digital and social media.
• Studio — everything in Pro plus broadcast and paid-advertising rights and team use. (Team seats and RAW/LOG deliverables are described where available.)
• Enterprise — custom scope agreed in a separate written order or master services agreement.
• Single-clip purchase — a one-time à-la-carte purchase grants a commercial license to that specific clip, equivalent to Pro scope for that clip only.

A written certificate is issued for each licensed download and is available under your account. If you later move to a broader plan, the license recorded for a clip may be upgraded, but it is never downgraded.

4. Permitted Uses

Within your Plan's scope, you may:

• Edit, cut, resize, color-grade, and combine the Content into End Products.
• Distribute your End Products across the media covered by your Plan.
• Use the Content in an unlimited number of your own End Products, with no expiration on End Products created during an active Plan.
• Use the Content in monetized content to the extent your Plan permits (e.g. ad-supported videos, sponsored posts, client deliverables on Pro and above).

5. Prohibited Uses

You may not, regardless of Plan:

• Redistribute or resell the Content as-is or in a way that competes with Cars4k — including uploading it to another stock, footage, or media library, or offering it for download, streaming, or sale on a standalone basis.
• Use the Content as the primary value of a product where the Content itself is what is being sold (e.g. a clip pack, a "car footage" template store, an NFT, a screensaver, or a wallpaper app made mostly of our Content).
• Sub-license, rent, lend, assign, or transfer your rights to a third party, except that a Pro or Studio licensee may incorporate the Content into End Products delivered to clients.
• Use the Content in a way that is defamatory, unlawful, or misleading, or that implies endorsement, affiliation, or sponsorship by any vehicle manufacturer, brand, driver, or person depicted, without their permission.
• Use the Content in connection with pornographic, hateful, discriminatory, or otherwise objectionable material, or to promote illegal activity.
• Use the Content to train, develop, or improve any machine-learning or generative-AI model or dataset, or otherwise for automated data mining, without Cars4k's prior written permission.
• Remove, obscure, or alter any watermark on a free (watermarked) download, or attempt to circumvent download limits, access controls, or signed-URL protections.
• Use trademarks, logos, or the likeness of identifiable persons or private property shown in the Content in a way that requires a release you do not hold. Cars4k does not provide model or property releases; you are responsible for obtaining any that your use requires.

6. Downloads and Limits

Each Plan includes a monthly download allowance shown on the Pricing page. The allowance counts distinct clips: re-downloading a clip you have already obtained in the current period does not consume an additional download. Unlimited allowances (where offered) are subject to fair-use and anti-abuse limits, and Cars4k may suspend downloads that indicate bulk harvesting or automated scraping.

7. Free Watermarked Downloads

Where offered, a free watermarked copy may be downloaded for evaluation and personal reference only. The watermark must remain intact and unobscured. A watermarked copy is not licensed for use in any public, commercial, or monetized End Product. To use a clip, obtain a plan or purchase the clip to receive a clean, licensed Master.

8. Audio and Music

Cars4k Masters are silent or contain only vehicle/exhaust audio — no Master ships with embedded third-party music. You are responsible for any separately-licensed music you add to your End Products. Exhaust audio provided by Cars4k is licensed under the same scope as the rest of the Content.

9. Ownership and Intellectual Property

The Content, the Cars4k platform, and all related intellectual property are owned by Cars4k or its licensors. Nothing in this Agreement transfers ownership of the Content to you. You own the original elements you add and the overall End Product, but not the Cars4k Content within it.

10. Term and Termination

This Agreement applies from your first download and continues for as long as you use the Content. If you materially breach this Agreement, your License to the affected Content terminates automatically, and Cars4k may suspend or terminate your account. On termination for breach, you must stop using and, where practicable, remove the affected Content from any End Product not yet published. Licenses to Content lawfully downloaded and already incorporated into published End Products before termination survive, except where the breach relates to that Content.

11. Warranty and Indemnity

Cars4k warrants that it has the right to license the Content to you as described here. To the extent permitted by law and subject to the limitations in our Terms of Service, and provided you have complied with this Agreement, Cars4k will defend and indemnify you against third-party claims that your permitted use of an unmodified Master directly infringes that third party's copyright, up to the amount you paid to Cars4k in the twelve months before the claim. This does not cover: use outside your Plan's scope; modified Content; use requiring a model or property release you do not hold; or use of trademarks, logos, or likenesses shown in the Content. Except for this express warranty, the Content is provided "as is".

12. Changes to This Agreement

Cars4k may update this Agreement. The license that applied to Content at the time you downloaded it continues to govern that Content; changes apply to Content downloaded after the change takes effect. Material changes will be notified as described in our Terms of Service.
